No. 1 means licencing for commercial purpose, which I'm totally fine with, and surely many users, especially if they map for fun and not for financial interest
No. 2 means total control over user-created IP, which is the whole reason of this dilemma

My point is that it would completely suffice if Blizz stated "whatever you make with this editor of ours, you can't make any money out of it but through us"; instead they're stating "whatever you make with this editor of ours already belongs to us."
That's a very interesting debate. Let me just ask: Who says so? Blizzard could easily pick the top 10 most popular user maps and sell their respective modified versions as bonus content. It's their IP as soon as Galaxy goes online. Blizzard could as easily claim any brilliant and popular game...
After all the hype they made about it, I actually expected Blizz to make the Galaxy Editor ready for custom script as it comes, instead of having some mapmaker/programmers implement it in their free time.

I can't remember reading THAT in the WC3/TFT EULA. If so, Blizzard would have any reason to sue some of the companies that made a proper game out of popular WC3 mods...
