Yea, I known these companies always whine about copyright infringement, they are not the ones who are stealing your "copyrighted material" it's the users. If you go into a bar and everyone is using some sort of illegal substance, do the cops arrest the bar owner and let the rest of the people free? I don't think so...

Your ignorance is just going to make more people hate you more and promote more illegal software/music/etc downloading (which I call "sharing")

I don't really care if it goes down or not, but as many said before, there will appear even more sharing sites. Sharing will never be put down by the giant companies and it will end up with said companies embracing file-share.

Which could be used to accurately describe Google, Yahoo! Answers, Ask.com and many similar sites. They all link to illegal material.

Well, there's a huge difference between making a site devoted fully to internet piracy and just a site for... everything.

Stupid example, yet relevant:
You don't ban knives because people get killed by them.
99% of the knives are used peacefully.

Google Stair Way to Heaven in both, Pirate Bays first link is probably a link to download it. Goggles first ten pages will be information about led zeppelin and music videos of the song.

I dont blame them for having links to illigal stuiff on there site - I blame them for not doing anything about it when they knew.

Stupid example, yet relevant:
You don't ban knives because people get killed by them.
99% of the knives are used peacefully.

but you do ban large guns as they are not used properly.

Fact: There is a bunch of sites out there that can be somehow used to find illegal material.

So what makes The Pirate Bay different from other trackers or even Google? It's the fact TPB actually admits it and admits they hardly ever remove anything. This is what makes people upload "illegal torrents" (in lack of a better term) there. It is also what gave them popularity and is their downfall.

If you add some magic filter like "filetype:torrent" to your query, Google or The Pirate Bay will serve the same purpose. Give it a try for "Stairway to Heaven".

There are a lot of similarities between both sites, be it the fact that they're content agnostic or that they're aware that illegal content is being indexed/served. Neither hosts the provides original content, it's being generated by third parties. The Pirate Bay offers a "Top 100" link, so does Google.

The analogy is wrong. The Pirate Bay plays another role: do you jail the shopkeeper because he handed a knife to someone that used it to kill somebody?

The outcome of this "trial" is not surprise at all. The Four fought the System and the System won. By what means this victory was achieved will remain a mystery, but given the poor job done by the prosecution, some outside "influence" happened. The leaked verdict or comments made are just other indications.

This trial isn't about piracy, it's about control of content. Be it the DMCA or the ACTA, both serve the copyright holders' needs, neglecting even fair use.

The defense had some strong points.

A) Stealing means taking something that cause directly damage to the victims and directly helps and thief. This is not the case. Its like arresting someone for say, taking a picture of something that isn't his.
B) They are accused of damaging the companies potential profit. This is like arresting someone for having a potential to kill someone.
C) And again LINKING IS NOT A CRIME. TBP never uploaded or distributed illegal material. They did nothing but pointing to it or rather organizing it in one place.

A) This wasn't part of the defence nor the charges. Copyright infringement has nothing to do with property rights, at least not in Swedish law.
B) True, but they didn't use the "defence" you're stating.
C) They was convicted for the pointing and organizing, not uploading or distributing. The uploading and distributing charges was dropped very early in the trial.

The loss of the Reputation comments data when we switched to Xenforo really was the death knell for the site when it came to all the users that left. I know I missed it so much and I got way less interested in the site when that feature was gone and I run the site.
