A court in Sweden has jailed four men behind The Pirate Bay (TPB), the world's most high-profile file-sharing website, in a landmark case.

Frederik Neij, Gottfrid Svartholm Warg, Carl Lundstrom and Peter Sunde were found guilty of breaking copyright law and were sentenced to a year in jail.

They were also ordered to pay 30m kronor (£2.4m) in damages.

In a Twitter posting, Mr Sunde said: "Nothing will happen to TPB, this is just theatre for the media."

This came as a shock to me, they haven't comitted copyright infringement. I think the justice system came under so much pressure from various industries, they sentenced them to appease them.

Well, it came as a shock BECAUSE earlier in the trial, the copyright infringment charge was dropped for having no basis. Now we hear that the court did a complete 180 degree turn and sentenced them to jail for this charge.

Wouldn't be surprised if there was a bit of bribery going on here...

Damages? What Damages?!

Would you order Bill Gates to pay millions and serve 1 year in jail because he caused Apple to lose money in the computer industry?

I would. Questioning the integrity of the law institutions of this world borders insanity. Alse, think about the media exposure that'll happen if bribery in this particular case got out.

Competition is hardly the same as theft, which piracy is.

You're telling me that we shouldn't question the integrity of the law? THAT is bordering insanity. Letting a select few rule over everyone without review or regulation, think about that for a second.

The court dropped the copyright infringement charges because, obviously, they hadn't comitted the crime. Yet as the trial came to the moment of truth, they decided that they were, infact, guilty of this crime. This looks 'dodgy' to me and I think it warrents questioning of 'integrity'.

Competition is hardly the same as theft, which piracy is.

The owners of TPB never comitted a crime. Their website allows users to link their computers together and share data. If that is classed as theft, then the guy who made the internet is in for a whole load of trouble.

And yet, no one plans to close them down for "assisting piracy"...

This is bullshit !

They are not infringing any laws in Sweden and do not host any copyrighted material on their servers! If you live there, laws used in other countries (USA ?) do not apply there!
Yet they sentence them and TPB keeps going, it's a win/lose situation in my opinion.

The hell.

I find it weird how much people on the internet complain about how 'unfair' it is that people that do/support internet piracy get sued.

They weren't hosting any copyrighted content, so I'd be willing to bet the police were bribed.

if they were going to be charged with anything, it should be that they refused to take off torrents to content that is copyrighted... and most of the "damages" that the music industry describes comes from them leaking music earlier then when it's supposed to be released, and then complaining that a bunch of people already heard it via some sharing site.. isnt it their fault for leaking it?

WTF this really sucks :( and 3M kronor is like i think not sure 300 000 d$ correct me if i'm wrong cause 10 kronor is 1$

I don't think they get jail "when they did a appeal against it" not even need pay in the end..

Both parties are going to appeal.

I've yet to read the verdict but there seem to be a few interesting things in it:
1. The money is supposed to be paid by the group as whole, since three of the persons lacks money this means that the fourth one will be required to pay everything himself. Though, I do think that he has money enough to afford it on the other hand this person is barely related to tpb, tpb bought servers and bandwidth from his company and he was interested in advertising with them but never did it. The only logical reason I can see why he was also charged is that else there would be no money to win...
2. They are not found guilty of copyright infringement but instead "knowingly making copyright infringement easier" or something like that.
3. They are accused of being organized :p

The more interesting outcome is that the Pirate party got 2000 new members today. :D

If you're wrong and it does get out, we will witness it soon enough. :)

Anyway, from the TPB blog before the verdict:
On friday we will get the verdict in the ongoing trial. It will not be the final decision, only the first before the losing party will appeal. It will have no real effect on anything besides setting the tone for the debate, so we hope we win of course.

So, the dice courts judgement is here. It was lol to read and hear, crazy verdict.

But as in all good movies, the heroes lose in the beginning but have an epic victory in the end anyhow. That's the only thing hollywood ever taught us.

I can see everyones point about them not being guilty because they don't host anything illegal but they are the gateway to copyright material. Without them the real hosts of the data wouldn't be getting any downloads. Officially they are free to go in my opinion but reality is different. I'd compare the case to someone who puts an instruction online on how to build a bomb and consequentally after a crime is guilty for giving the criminals the instructions.

I heard something on the radio too that unlike Youtube & Co they didn't have proper Terms &Conditions which made the uploader and not them at fault. Don't know if its true though.

I'd compare the case to someone who puts an instruction online on how to build a bomb and consequentally after a crime is guilty for giving the criminals the instructions.

A more accurate analogy is someone who hosts a chat room in which people are free to discuss what they want, including how to build a bomb.

ok srsly, trying to sue something related to the internet has always been bull, if you sue something every one can do, everyone has done and everyone will at some point do, you're suing someone for eating fish.... It's BOUND to fail.




But for some reason it DIDN'T!??!?! wt* did i miss?!?!?!?
