Interesting Occurance for DII:LOD

I was just curious about something that occures when my friend and I try to play. Sometimes when either myself or my friend create a normal game, the other person keeps getting a message saying the "Game does not exist" when infact...it does. According to battle.net, we are both on the same server as well. Does anyone know what my be causing this?
 
one of you is tagged as a hacker is my guess.... have any map hacks?
 
the same thing happens to me and my friend and none of us use any types of hacks . can anyone help?
 
I think Cain still tags people too, so if one of you had the unfortunate mistake of talking to Cain in act 4 and dropping, then that would be the cause.
