Due to some serious account problems with Blizzard's WoW people, it looks like I'm hiring a lawyer to sue.

Not only that but have you noticed anyone who posts they do not like the Draenei or BC have had their posts removed from the messageboard?

It's one thing for Blizzard to jerk around with people on a free registration site, it is another when it is part of the packaged deal for paying for an account.

Course there are other problems I have not just the CMs, but other account issues that look like I need to get a lawyer to settle.
 
Don't waste your money. You are trying to sue a big company. Just move on and stay away from the forums or WoW.

Those emails were "answered" by an invalid respondance (no name, using the generic reply mailer). See Contract Law states, no matter how "fancy" a ToS agreement is, it can never, not once, supercede state or federal law.

Things such as Spyware: The Wardern (all spyware is outlawed, period), sending my systems information without requesting first (outlawed, period..), etc.. are just a few of the list of things goin on.

Then I started getting this harassment bullplop from the Mystery CM who hasn't kept any records of why actions were taken on my account but took those actions anyway (illegal - against sales laws here in colorado), right after I send a complaint letter to the California AG office and LA BBB concerning illegal collection of system specs (of which they no longer collect).


Ever since then trying to get any response from email concerning to do with anything about WoW has been impossible. Yesterday was the first response I received in mail after two months of reporting harassment from the CM.

It's gone to the point where I'm fed up.

I really like the game, but the prick who's been jacking around with me has just gone too far. Especially with that anonymous email crap.
 
Anyway the few lawfirms I contacted explaining the situation said that a class action may be where to go and it sounds like the deal with what's been going on is more than a little shady.

I am just infuriated with this mess. Blizz CR has been total crap ever since they sold out to VU.

No, that is not true.

If you read the Terms of Service, it says that The Warden is part of the WoW package. If the ToS tell you that there is spyware in the program, then it can be in it, because "I agree" binds you to whatever they say. Also, the Warden doesnt really send your personal information to them, UNLESS your hacking. Then it Red Flags you, and sends things. Otherwise it is fine.

But I have to agree, Blizzard is doing a horrible job at their Biz, I mean there servers are shitty, they constantly go down. Their support blows, and you dont get any help. And there forum mods are fags. :mad:

Yeah, but can you sue them for crappy service?

No, not really. Unless it's cheating you out of your money, you can't.

This is true, but you don't have anything of the sort against them. They didn't steal your baby or your money.

People are paying $15 a month, even though their servers are crappy, right?

So to boil it down:

Blizzard is lazy, and doesnt want to get off their ass and fix the stuff that doesnt work, so maybe their customers would be happier.

That's what AOL said in the late 90s. Remember that big lawsuit?

It was on a Friday afternoon, servers dropped. Aol said, oops sorry. But thing was, a lot of lawyers and lawfirms couldn't send their time sensitive material -- the suit ended with the court finding AOL at fault for not providing service. The judge was pretty explicit that internet service agreements hold no liability only IF the service interruption is not due to their equipment (i.e. only if the phone lines go down are they not liable). If it is their equipment -- it's their liability.

There's a lot in Blizzard's Terms of Service and EULA which is not legal. Especially the spyware bit.

Downtime to fix servers is one thing, but their constant droppings, their failure to uphold their customer service agreements, etc.. that is what's screwed up and that's for what they can be held liable.

That's where I found a loophole in blizzard's community forums.

The Community Forums are not "free forums" you have to be a paying customer to use them. Therefore -- according to every lawyer with whom I spoke -- the Community Forums are considered part of the service provided :)

Because they broke their ToS agreement with me, they can be found at fault. Now if the forums were free to anyone to sign up, well, that'd be a different story entirely. I'd be screwed, but then again I'd just make a new account.

Course that's not really the only thing that's pissed me off. I've been more than pissed at that entire spyware crap and background downloader they've been using. Now that IS illegal. The problem is you need to get someone to actually press charges before it's investigated.

I mean if Microsoft can't get away with that crap, why should blizzard? That spyware crap has screwed my computer up more than once. I've gotten errors from their spyware "The Warden" and it winds up freezing my comp or locking out my mouse. Totally pissees me off. And no it is not detecting hacks cause I don't use hacks. It's just interfering with the running of my system.


2g ram athalon 64 4200 dual core should not be getting jacked around by their spyware or background downloader.

(despite the fact the BG downloader doesn't actually download, it still runs periodically)

Spyware is not permissable under any circumstances. Whether or not it is in the Terms of Service.

Not to be mean "Kevin", but it just sounds like your butthurt. This is what america is coming to, to be sue happy. I hate suing, and it should be used when it NEEDS to be, not at every little thing. Its a game, if you dont like what it comes with, dont play it. Simple as that. Dont sue them, because they dont like you, or the banned you from the forums. Big deal? So good luck with that, ive been sued by Big companys before ( *cough* Myspace *cough* ) and the judges always lean towards them.

Except the program seems to be doing everything but detecting hacks. It should not be scanning my files and locking up my computer the way it is. Other companies can manage creating software/coding that isn't spyware to prevent hacks. Even nProtect does a better job than blizzard's "Warden" and it's not spyware.

funny.. i thought nprotect WAS a spyware.. nvm looked it up, its a norton program.. just as good as spyware though =/ evil norton..
 
I don't mean to burst ya bubble Kevin, but since you've come here all you've done is Bitch and Moan about Blizzard. It's a frickin computer game for fucks sake, I really do not see why you'd Sue someone over a Computer Game.

If you don't like what is happening, quit. Pure and simple; Quit the game.

Sorry, just all this complaining has started to get on my nerves. If you wanna find people that agree with ya, you'll most likely find them on the Official boards.
 
Lol. If you want to spend 200x more on lawers and court fees than you spent on that game, feel free.

    It is OK though for the main page to open up on the forum in the view it was before. As long as the portal has its own URL so it can be viewed that way I do want to try it as a regular forum view for a while
