"Charge gold and lumber" spell ignores upgrade

I have a spell based of "Charge gold and lumber"
And I have an upgrade.

I have set the "Techtree - Requirements" to "my upgrade."
I have set "Techtree - Check dependencies" to "True"

And yet i can cast my spell without researching!

The smallest hint of what the problem is will be apreaciated.

i don't know if this is true or not, but isn't there something like "techtree - tier's used". that may need to be set to 1.
