HOw to allow a hero to have two of the "same" spell?

I'm creating an AOS and I will create a item which summons an ORB as a locust unit (like locust swarm) but I have a hero which have s pell based on locus swarm, so:

1- If I use the iten when the heroe is using it's spell the first is canceled or both can work fine?

You can create the unit through a trigger, using a different ability...

2.When you cast a spell it issues stop first so you cant have 2 active
