Facebook Application Finds a Pinch of My Music

Which while the title is suggestive I may be getting some exposure, this is what I'm seeing:

Basically I was looking at a friends page, noticed this music tab, and figured I'd check if it lets you upload things since I do music stuff and that would be nifty. So while I'm just looking over it, figured I'd search my own name... and it gave me that. I have not uploaded the song "Leaving a Trail" to FB before. I have not made an InvisibleObserver account, and I have not been notified by anyone doing so on my behalf.

Now the good thing is that the "Leaving a Trail" link with an ID number from it matches the songs posted ID from Newgrounds;

And the player from facebook is unable to retrieve the song file from either. My concern however is that these have somehow connected, and I don't think its an automated system, otherwise it should have picked up a lot more songs of mine as "InvisibleObserver" from newgrounds. The comment about Nepean Ottawa while not being precisely where I live is awfully close, and not info privvy from Newgrounds.

So my thinking is someone has gone and done this without my know and sucks at PC's or something among those lines.


Now this means I'm showing up on something without my will, and its not functioning. Whats the deal / Why do I care?

I understand posting my music on the internet means people are going to grab it, use it, not credit me, and in some cases try to sell it or make profits. The issue is a very large application on facebook having my song with a "buy ring tone" option next to it is a breach of music licensing laws.

I'm going to be seeing about contacting facebook and see if I can find whats up.


Specifically what I am hoping this thread achieves is if anyone has had similar experiences, knows anything about how the application works, knows how to contact FB, or the app owners, or how to gain control of the "InvisibleObserver" profile. Any specifics on law related content will be good to know too, because in the small event this escalates or happens again, I'd prefer to be proactive when it comes to my music.

Well a lot of times where you're at can be traced based off of your ISP because you'll hitting their servers or towers or whatever. I'm not sure that they have really broken legal grounds unless they're claiming it's theirs (not sure if they are), unless you made a disclaimer somewhere saying not to upload it elsewhere. Things like that were left in a gray area from what laws I've been reading up on (which is more like fair use, copyrights and concept ownership, international corporation and tax, and immigration recently).

Trying to make money off other people's work is definitely illegal.

I believe so, cuz of the "Buy - Dedicate - Ringtone" thing. But I guess if the file wont even play they're doing a pretty bad job of it. :p

Well yeah that bits obvious but I assumed he was just looking for information about nonprofitable distribution.
